Bug columnists face legal action

THE COURTS:

A Sydney-based firm producing and marketing the Cochlear Ear implantable hearing device has launched legal action against two senior columnists for The Bug.

Documents lodge with the Supreme Court in Brisbane reveal that this publication’s finance and investment columnist, Morrie Bezzle, and its sex advice columnist, Dr Dick, (left and right in main picture) are alleged by Cochlear Limited to have infringed its copyright.

In the documents, Morrison Edison Ponzi Phar Lap Bezzle, age and address unknown, is alleged to have marketed a product manufactured by Dr Dick which was misleadingly named in a blatant bid to leverage the reputation of the Cochlear company’s hearing assistance device.

The documents allege that the sales campaign of the Bezzle-Dick product in question was aimed at men with sexually transmitted “penile or scrotal rashes, warts, or other dripping, oozing, or weeping pustules” .

“The product is a cream applied from a squeeze tube which Bezzle and Dick claim will clear up such conditions within three days of a purchaser applying it to their genitals,” the company’s claim said.

“But analysis by industrial chemists hired by Cochlear show that the cream could not perform as claimed and was in fact simply relabelled tubes of a home-brand toothpaste purchased from an unknown source in China.

“Further, the company’s investigations have revealed that the toothpaste in the tubes has been banned from sale in the Chinese market after it was found to contain high levels of asbestos.

“The company seeks to have the distribution and sale of the Cock Clear product banned and for Mr Bezzle and Dr Dick to be ordered to pay compensation to Cochlear Limited for the damage sustained to its reputation,” the court documents said.

Mr Bezzle and Dr Dick could not be contacted for comment.
